AI is an evolving and often complex topic in the creative industry. At Jacky Winter, we believe in supporting both artistic integrity and commercial innovation. We are also proud to represent a diverse community of artists with equally diverse views on AI. Our role is to respect these positions while helping both artists and clients succeed with clarity and integrity in their creative projects.

This document outlines our current approach to AI.

What We Guarantee as an Agency

• —•Human-made artwork: Unless otherwise discussed and agreed in writing, all final commissioned artwork delivered by Jacky Winter artists will be human-made and not created by generative AI systems.
• —•Transparency: Some of our artists may use generative AI tools in the early stages of their process to help create image references, mood boards or variations of preliminary sketches more efficiently. Our visualisation artists may use generative AI tools to help create storyboards or animatics for pitching or research purposes. The specific ways in which generative AI may be utilised will vary depending on the artist and the project. Our artists are happy to provide more information on the ways they use (or don’t use) AI tools if required - just ask.
• —•Case-by-case opportunities: We recognise that AI presents new opportunities for collaboration and are open to discussing and exploring AI projects (such as custom AI model development, AI visualization tools and other AI applications) with the relevant artist’s involvement and consent.

What We Ask of Our Clients

• —•Respect our artists’ rights: Artwork provided by our artists is licensed for use as delivered, for the specific uses outlined in our written agreement and quote. Artwork should not be modified, extended, animated or adapted through use of AI tools unless this has been discussed beforehand and expressly permitted in writing.
• —•No unauthorised training or scraping: Our artists’ work (including preliminary sketches and roughs) must not be used to train AI models, uploaded to AI platforms or fed into AI programs unless this has been discussed beforehand and expressly permitted in writing.
• —•Ask before AI Integration: If your project involves AI components or you're considering using generative AI tools as part of your workflow (including during pitching, animation and/or to assist with final artwork application), please discuss this with us upfront so we can keep our artist informed and ensure they have given consent. We're happy to explore solutions that work for everyone.
• —•Let us know if you have rules around AI use: If your project has specific rules regarding AI use, or requires that AI is not used at all, please let us know upfront so we can instruct our artists accordingly.

Why This Matters

Many current AI image models have been built using datasets of uncertain origin, often without artists’ consent or compensation. The rise of AI tools that can easily alter or extend existing imagery also creates new concerns for artists when it comes to quality control and artistic integrity of their work.

Until clearer ethical, legal and industry standards emerge, we believe that transparency and clear communication are key to navigating this evolving landscape.
